When the Minnesota Legislature reformed Minnesota’s construction defects laws to encourage more multi-family development, it added an additional requirement for homeowners associations.
Under the new law, which went into effect on Aug. 1, 2017, the homeowners association board of directors shall prepare, approve and follow a written preventative maintenance plan, maintenance schedule, and maintenance budget for the common elements of the property.
Since the developers of multi-family projects act as the initial homeowners association, Housing First Minnesota gathered a workgroup to prepare a sample maintenance plan for it members, which is available on the members-only Contracts page of BATC.org. The workgroup included:
